Humanitarian & Compassionate (H&C)
If you are ineligible for regular immigration programs but have strong ties to Canada or would face serious hardship if forced to leave, the Humanitarian and Compassionate (H&C) application may offer a viable route to permanent residency from within Canada.
Who Can Apply?
You may qualify for an H&C application if:
You are living in Canada without valid status or on temporary status.
You’ve established deep roots in Canada — work, education, community involvement.
You would face medical, safety, or social hardship in your home country.
You have Canadian-born children or dependents who rely on your presence.
You are a failed refugee claimant with new compelling reasons to remain.
What IRCC Considers:
Best interests of children involved in the case.
Level of establishment in Canada (jobs, schooling, community).
Risk and hardship in your country of origin.
Family dependency and special circumstances (e.g., domestic abuse, medical conditions).
H&C applications are only available from inside Canada and cannot be used to bypass refugee claims or be filed while a refugee claim is in process.
